Less than a week has passed since the Capitol riot, and the Democratic Party, the establishment media, and Big Tech now present it as axiomatic that President Donald Trump incited the mob for the purpose of preventing the electoral vote certification and, presumably, grabbing dictatorial powers. Republican Senators Pat Toomey and Lisa Murkowski have joined the calls for Trump either to resign or face a second impeachment, and even Ted Cruz has said that Trump’s rhetoric “certainly contributed to the violence that occurred.” But before the lynch mob gets the noose ready and hangs the president from the nearest tree, it would be useful to step back and make sure that he really did what everyone seems to be sure he was guilty of doing: incite the crowd at the Capitol to violence for the purpose of staging a coup.
Trump’s speech that supposedly incited the mob is here. At the end of it, he said:
So we’re going to, we’re going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we’re going to the Capitol and we’re going to try and give… The Democrats are hopeless. They’re never voting for anything, not even one vote. But we’re going to try and give our Republicans, the weak ones, because the strong ones don’t need any of our help, we’re going to try and give them the kind of pride and boldness that they need to take back our country. So let’s walk down Pennsylvania Avenue. I want to thank you all. God bless you and God bless America. Thank you all for being here, this is incredible. Thank you very much. Thank you.
The attentive reader may have noticed that there is nothing there, or in any other part of the speech, calling upon the crowd to storm the Capitol, or to overthrow the government, or to do anything but walk down Pennsylvania Avenue and encourage lawmakers to support the president. The case for the claim that Trump incited the mob rests on the proposition that he didn’t have to spell out what he wanted them to do; when he detailed his reasons for believing that the 2020 presidential election was stolen, that was enough to inflame them sufficiently to storm the Capitol.
However, assuming that the crowd would have remained peaceful were it not for Trump’s criticism of the election is to embark upon an extremely dangerous path. To take for granted, as so many do today, that Trump incited violence by criticizing the election, is to commit the classic logical fallacy of post hoc ergo propter hoc, after this, therefore caused by this. It opens the door for criticism of anyone or anything to be labeled dangerous and inciting of violence, and silenced accordingly. Tyrants and would-be tyrants can silence criticism of their rule by claiming that their opponents, by engaging in that criticism, are inciting and inviting violence.

The president asked in advance that his supporters march peacefully to protest a stolen election. When certain attendees in the crowd who appeared to have come to create trouble surged forward, other attendees tried to stop them.
President Trump then asked people to go home ‘in peace’.

If anyone should be impeached or kicked out of the govt, it is the democrat Congress people. If hypocrisy was a crime, they’d all be in Gitmo. The only thing ‘good’ about this ‘defeat’ is that the Republicans are exposed for who they are. While the House has generally been pretty good about it, I’m glad that McCarthy stated that there will be no whip, as a result of which the 6 House republicans are gonna move to ‘censure’ the president, whatever that means. And in the senate, a handful of senators – Romney, Murkowski, Sasse and maybe a few others, can vote alongside the Dems to convict.
At least this way, we all know whom to primary next year. Maybe this is what was needed to flush out the Republican Guard from the GOP

That’s because he made no call for violence … only that people express themselves using the right of assembly and the right of free speech.

He said, “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”

So they want to use the 14th Amendment Section 3 against him to sabotage his chances of ever running again. Except that that law applies to congressmen – house and senate – who call for an insurrection, and prevents them from running for the same seats again! But it does not preclude them from running for the presidency. For instance, Kamala Harris raising money for the Minnesota Freedom Fund could be thrown into this, and under that, she could be precluded from ever running again as senator from California, but she’d still be free to run for president or vice president. However, note that this amendment does not apply to the president: the rules about them are completely distinct from everybody else, since that one person represents one of the 3 branches of government
The other points – Article 25, which is now the wet dream of Trump haters in both parties – applies only if the president is incapacitated, not if he does anything criminal. That’s what impeachment is about, and that too is meant to cut short the presidents term in office, not fast-track his exit if he’s already on his way out. If they can impeach him after he leaves to prevent him from running, they can impeach anybody who might run in future to automatically disqualify them, but that’s not why impeachment exists

Trump did not incite, and indeed, his words seem no more incendiary than many whose supporters demostrated peacefully at the Capitol or elsewhere in the past. But I do not doubt that even if there were false flag provocateurs in the crowd, I also do not doubt that there were also many Trump supporters in it as well. Crowds often take on lives of their own. Nobody knows this better than the Democratic Party, which has exploited it for as long as I have been politically conscious.

I read it as a “threat.” I consider a warning something like, “The bridge is out; take a detour,” or “Hurricane A is on the way here; evacuate.” Those things can and will cause injury and death…and the one warning doesn’t take the action that causes the injury/death.

Before today I had not seen the full video of President Trump’s speech so I just watched it. It’s over an hour long and by the time he got to the end of his speech I was getting bored. It’s obvious to me he had no intention of inciting violence in his listeners. He wanted a peaceful march to the Capitol and for his supporters to show, again peacefully, that they wanted the vote tally from certain states to be rejected so that a closer examination of the results could be conducted. I think it’s a huge distortion to say that he was calling for murder and the overthrow of the country. What BLM and Antifa have advocated and done during the past year are by far worse than anything he said at that rally. That is what exasperates me.

And I heard Andrew Wilkow say that the 14th Amendment Section 3 is about legislators who call for an incitement to violence from running again for their seats, but again, it doesn’t preclude them from running for president. In other words, if this was successfully used against Kamala, she couldn’t run again for California senator, but she could run again for vice president or president
Let’s say President Trump decides to run again in 2024, and someone in either party decides to challenge that. Let’s say that somehow, he wins that election again and the legislators decide to challenge the legality of it based on this impeachment. In that case, will SCOTUS be able to dismiss it on ‘standing’? And if they do, then doesn’t he just walk right back in to the White House?

With lawyers interpreting the laws, one can get different answers. And what if it is shown that they are trying to unseat a seated president with falsified “evidence”? They have really committed a crime in that case.
These ones pretend to know the law and pretend to uphold the law and to use the law to make decisions. But, they don’t always follow the law as it was written.
That is why so many said the challenge to the ‘election’ results was “unprecedented,” and wrong to do; that the ‘results’ were supposed to be accepted and talk of fraud was what was wrong.

As for education in the legal realm: The Major portion of my education was Public Safety/Criminal Justice with heavy emphasis on anti-terrorism. Many of the courses were directly about the laws…on what the police do, what the courts do, prosecutors, how to collect evidence, how to protect it. the “custody” thingy, what is allowed and not, “fruit of the poisonous tree”, etc., I took courses on Hostage Negotiation, Criminal Profiling, Geographic Profiling, and a host of other courses all concerning different aspects of the law and how it is applied. The Amendments and rulings by the Courts, were a large part…over and over…such as the Miranda and Terry Stop, and I had to write briefs just as an attorney would, though I was not able to continue on to law school.
However, I did help my son with his courses and he graduated from UF Levin Law. with honors. We have had a lot of discussion about the law and its application.
One of my professors, and I was in several of his classes, was a Special Investigator with the FBI, and actually designed the program, and wrote the book on Hostage Neg. after the Waco disaster. We had a lot of outside the class discussions.
One thing I discovered: an attorney will argue one day for a case citing laws and court rulings and the next case, maybe the next day, he will use the same information/facts to argue the other side; depending on who he is representing.

My son said I should be a judge, so when I had to write a paper on ethics, I wrote as if I was sitting on the bench. My son gave me a nickname for me as judge, but I won’t share that. Not bad or evil or ‘blue’ or anything like that, just really silly.
And for one of my anti-terrorism papers, I used Mr. Spencer’s works as one of the sources. There was not a lot of info on the net at that time about jihad…at least not helpful for a serious paper. I read one of his books that was pretty informative and gave a lot of background. And I found this site while searching for sources. After my paper was finished, I still kept coming back to the site.
At first, I was what you call a “lurker.”

It’s similar to a parent saying about their kid who is late getting home, “I’m gonna kill him”; that is something just about every person has said in a time of worry or frustration without the intent to murder. And other times when a word is used in speech without it’s literal meaning, such as, “I **love** spaghetti* is not the same as “I love my little boy,” but it is the same word.
Fight is used in many different ways and most people who have a brain and and honest heart, will apply the meaning the speaker means.

I had to look that up. Kind of like “go to hell” when speaking to a friend who knows you well, and they say ‘you first.’
When I was a teen, lot of words were used one way and then another for the opposite meaning…same word. Like cool was good except when it wasn’t and bad was good except when it was bad.
But some people misunderstand on purpose. like pelosi and shummer and cheney and so many others. and I don’t give a hoot if I misspell their names.

I don’t tell people that either. I also have never used any form or word of profanity. Didn’t even ever say “hell” except when reading it in the Bible. Like Radar (mash) I said h e double hockey sticks, after I heard him say it that way. But never as a curse word.
I know Jesus said “what is in the heart, comes out of the mouth,” and profane words are just not there (in my heart). so, I can understand your friend very well on that subject.

The Black Lives Matter activist who was seen storming the U.S. Capitol on Jan. 6 was charged, the Department of Justice said Thursday.
A new court filing says John Earle Sullivan, 26, told FBI agents last week that he was at the Capitol when the breach happened. He said he entered through a window that had been broken out. He also said he was present when Ashli Babbitt, an Air Force veteran, was shot dead by a U.S. Capitol Police officer as she tried to climb into the House Speaker’s Lobby through a window.
Sullivan showed agents some of the footage he captured inside the building, which he and others entered illegally.
Videos showed Sullivan and others breaking through a barricade, with the Utah man shouting: “There are so many people. Let’s go. This [Expletive] is ours! [Expletive] yeah. We accomplished this [expletive]. We did this together. [Expletive] yeah! We are all a part of this history. Let’s burn this [Expletive] down.”

The woman he was speaking with in the video he made inside the capital building, is a cnn reporter. They were interviewed by anderson cooper the day after…maybe two days, but it seems like just the day after…about what went on inside, but he never asked what they were doing inside.

And she had just as much right to be talking on the sidewalk as did this creepy politician.

There is nothing wrong in providing employment for your own citizens first. This cannot be achieved whilst ever there are large political donations to parties to push their agenda. Antifa/ Blm acted as agent provocateurs by enticing a few genuinely disgruntled protesters to enter the building. These protesters may not have known they were breaking any law as they entered the people’s house. It is regrettable as they will be dealt with severely whereas the mob who destroyed entire cities (in the middle of a pandemic responsible for most of the deaths today) for close to a year were even bailed out by politicians and got off. And spread their political contagion to other countries who had nothing to do with America’s schitte. Antifa is a foreign global org responsible for trashing Europe in recent times whereas blm (genuinely concerned black people re civil rights has been infiltrated by various vicious entities for political purposes and unjust.
Regarding Schumer, now you see the hypocrisy forcing gender politics on normal family people and their children and where mother, father, sister are words to be banned in congress but his parties creation is to be removed as it is offensive to his sensibilities.
