Committed to freedom of expression in religious matters, the ECLJ defends Mr. Saïd Djabelkhir, an Algerian scholar sentenced on April 21, 2021 to a three-year prison term and a fine of 50,000 dinars for “offending Islam” and “denigration of the dogma” and “precepts of Islam” under article 144 bis 2 of the Algerian Penal Code punishing blasphemy. His crime: the affirmation that certain Muslim practices would be prior to Islam and of pagan origin, and that the content of the Koran and the hadiths wouldn’t have the value of an exact science.
Questioned by United Nations experts, the Algerian government invoked the unfortunate case of E.S. v. Austria of October 25, 2018 in which the European Court of Human Rights had validated the conviction of an Austrian speaker for having evoked the pedophilia of prophet Muhammad (see our article in French in Valeurs Actuelles: How Algeria relies on the ECHR to justify its repression of blasphemy, and our special program in French on RCF).
This case is important since, for the first time, in the coming weeks, the Algerian Constitutional Court will rule on the conformity with the Constitution of the criminalization of blasphemy and, through it, on the religious limits on freedom of speech and scientific research in Algeria. It comes shortly after freedom of religion was removed from the Algerian Constitution in 2020. It is therefore the moment of truth for Algerian constitutional justice.
To raise public awareness on this important case, the ECLJ co-signed a column in Le Figaro “For the acquittal of Saïd Djabelkhir and scientific freedom in Algeria” bringing together 19 international personalities. This article was quoted and commented on in several Algerian newspapers, notably Barlamaneand Algérie Part Plus. The ECLJ also sent a brief to the Algerian Constitutional Court in defense of freedom of expression in religious matters (Brief in French only).
This is a landmark case for fundamental freedoms and the construction of the rule of law in Algeria. Its outcome will determine whether Algeria will take the side of democracy and freedom in the face of Islamism. Algeria is a neighboring country of Europe, concerned by the neighborhood policy of the European Union, an important source of immigration where fundamental freedoms, in particular freedom of conscience and religion, are denied or restricted in the indifference of European authorities. Algerian converts to Christianity face both state and social persecution: state persecution through the criminalization of evangelization and the refusal to issue authorizations for the practice of worship in special buildings; social persecution through the various forms of discrimination, ostracism, intimidation, threats to physical and moral integrity, sometimes by family members.
Algeria removed freedom of belief from its constitution in 2020 and has carried out numerous administrative closures of indigenous churches after having at length tolerated their opening without official authorization….

The future certainly looks bleak…from a human standpoint…for the freedom of speech, freedom of thought, freedom of belief.
Thankfully, there are Ones Who see things from a totally different point of view. and They allow us to know of it.

Sharia law forbids Kafirs from speaking about Islam. It matters not whether the Kafirs makes perfectly true statements or false ones. Only the mullahs have a right to speak about Islam and they can say ANYTHING AT ALL … even outright LIES and MISREPRESENTATIONS of Islam, such as stating that Islam is ‘THE MOST FEMINIST RELIGION’ or that Islam ‘GIVES FULL RIGHTS TO NON-MUSLIMS’ or other such statements of TAQIYYA (sacred prevarication).
Islam is an HONOR-SHAME CULTURE and the only concern of mullahs is to promote the IMAGE and PRESTIGE of Islam, rather than an accurate representation of Islam in all its viciousness, misogyny and discrimination and backwardness.

St Augustine of Hippo (now called Annaba) was from Numidia, a province of the Roman empire, now called Algeria. As were 3 popes and 17 other Saints.
Algeria would do better to value their rich Jewish, Christian and Muslim history.

You left out that Muslim’s can’t and never offend any other religion or persons. They are the chosen ones who have the right of judgement over everyone.

Reply to JL: it is, in fact, THE MULLAHS (the defenders of Sharia law) who are upset by comments challenging the ‘HONOR’ or the ‘IMAGE’ of Islam.. The mullahs tell the radicals which person has crossed the line, and the radicals do the rest while the mullahs stand back and then denounce the crimes of the radicals with the benign expression of a cat who ate a mouse.
The ‘HONOR’ or ‘IMAGE’ of Islam is the chief concern of the mullahs. Mullahs make a living from promoting Islam through taqiyya. They have to lie constantly and make death threats to keep people from leaving Islam. That is what they are doing here.
However, many Muslims see the mullahs’ lies and they are leaving Islam anyway and in spite of the threats.
