📎 With a lot of attention around climate claims (like the EU Green Claims Act and more) it is important to understand the differences and make an informed decision for your sustainability strategy. Both ‘carbon neutral’ and ‘net zero’ are related concepts about balancing the amount of greenhouse gas emissions in the atmosphere with the amount removed. But, there are some nuanced differences between the two. 🔍 Where does carbon removal fit into these claims? 🌍 SEC's New Climate Disclosure Rules vs. EU's CSRD: A Comparison 🌍 On March 6, the US Securities and Exchange Commission (SEC) approved the nation's first national climate disclosure rules. These are effectively a counterpart to the EU’s Corporate Sustainability Reporting Directive (CSRD) across the pond, but with some substantial differences: 1️⃣ Scope of Emissions Covered Despite two years of negotiations, the final SEC rules are notably weaker than the original proposal, and do not include Scope 3 emissions (which can account for up to 90% of a company’s emissions profile) in the reporting requirements. The CSRD does require companies to report on their Scope 3 emissions alongside Scope 1 & 2. 2️⃣ Materiality of Risk While the SEC focuses primarily on financial materiality, the EU's CSRD embraces a double materiality approach, considering both financial and non-financial impacts. 3️⃣ Different Reporting Timelines The SEC's reporting timeline is somewhat delayed in comparison to the CSRD’s, with its requirements being implemented over several years starting in 2025. Meanwhile the CSRD's impacts are expected sooner; large public-interest companies will have to report on their 2024 emissions. While the SEC’s rules are limited, there's potential for a stricter global standard based on the CSRD as many companies affected operate internationally. EU regulations hold significant sway over multinational companies and supply chains, especially regarding Scope 3 emissions. As regulatory landscapes evolve, prioritising transparent reporting is essential for effectively addressing climate risks.
