Taxation with regards to EU business partnerships

Hello,

 

I am interested in opening a company to continue working for my former employer, as I have recently moved to the Netherlands from Poland. However, the company's legal department is hesitant to sign off on a freelancer contract for me, as they are afraid that they will be penalized for not paying taxes on my behalf in the Netherlands. Is this possible? If I pay my own taxes and VAT, and insurances, would they still be liable for paying any expenses on behalf? I would appreciate any advice.

Dear DKing325,

 

Yes, the legal department of your former employer has a valid argument. Especially if you're going to work for them fulltime.

 

In NL there are very specific (tax) rules and ongoing discussions regarding the topic of your enquiry.
